This is a full working draft written for OffCut. It should be reviewed by a solicitor before OffCut trades commercially.
OffCut is operated by OffCut Group Ltd, a company registered in England and Wales (company number 16842590) ("OffCut", "we", "us"). These terms apply every time you use the OffCut app or website.
You can reach us through in-app messaging at any time, through the Fast Help screen in the app, or by email at support@offcut-group.com. Membership and billing queries can be sent to memberships@offcut-group.com.
OffCut is a marketplace that connects buyers and sellers of surplus and reclaimed building materials. We are not the seller of any item listed. The contract of sale is between the buyer and the seller.
We are not responsible for the goods themselves, their quality, condition, accuracy of description, safety, legality, fitness for purpose, or for collection or delivery arrangements. We do not inspect items and we do not transport them.
You must be 18 or over to hold an account and the details you give us must be accurate and kept up to date. You are responsible for activity on your account and for keeping your password secure. Businesses must give the trading name and, where registered, the company number of the entity selling.
Listing on OffCut is free and sellers receive the full item price they set. Buyers pay a buyer protection fee on top of the item price, calculated on a banded scale:
The exact fee is always shown before you confirm a purchase and again on your receipt. Delivery charges, where a seller offers postage, are separate and set by the seller. Fee bands may change; changes only apply to purchases made after the change.
All payments must be made through OffCut. Card payments are taken by our payment provider, Stripe Payments UK Ltd; OffCut does not see or store your full card details. Your payment is held by OffCut under our SafeTrade protection until collection or delivery is confirmed, and only then released to the seller. This protects both sides.
Sellers must not hand over goods before payment has been made in the app, and buyers must not pay sellers directly. Arranging payment off-platform — including cash on collection or bank transfer — is a breach of these terms, removes all SafeTrade protection, and may result in account suspension.
Sellers receive their money as a balance in their OffCut wallet once an order completes, and may request a withdrawal to their nominated UK bank account. Withdrawals are checked by OffCut before payment and are normally sent within one working day, although the receiving bank may take longer to credit them.
Protecting your financial details. OffCut never sees or stores your full card details; card payments are handled by Stripe, which is certified to PCI DSS Level 1. The payout bank details you give us (account name, sort code and account number) are used only to send your withdrawals. They are encrypted in transit and at rest, are not readable through the app, and only a masked version (the last four digits of the account number) is ever shown on screen. Changing your payout bank details requires you to re-enter your OffCut password, and we notify you whenever they change. Payouts are only ever sent to the account saved on your profile. Keep your password private and tell us straight away if you receive a change notice you did not make. Staff access to payout details is limited to authorised finance staff processing withdrawals.
Collection orders are confirmed by the buyer giving the seller the order's collection code. Posted orders are confirmed when the buyer marks the item as delivered. Do not share a collection code before you have the goods.
Where a seller offers postage, the parcel sizes and prices shown in the app are OffCut's indicative guidance. The buyer pays the displayed postage charge at checkout. After payment, OffCut uses ShipEngine to compare supported carrier services and book a suitable available option. The carrier may therefore differ between orders and is not guaranteed to be InPost or any other named carrier.
Depending on the selected carrier and service, the seller may receive a mobile QR or drop-off code, or a printable postage label. The seller must use the issued instructions, pack the item safely and accurately, stay within the selected parcel dimensions and weight, and take the parcel to an accepted drop-off point. The label remains available on the order screen. Carrier tracking, where supplied, is shown in the app.
Standard parcel postage is limited to 15kg and to packages with no side longer than 60cm. Long, heavy or oversized items — including full-length timber, pipe, conduit, guttering, sheet materials and pallets — must be collection only unless an eligible Business storefront offers its own delivery. For storefront delivery, the seller sets the delivery charge and marks the order out for delivery; no ShipEngine label is supplied.
OffCut facilitates booking but does not transport the goods. Carriage is performed under the selected carrier's service terms, including its restrictions, compensation limits and exclusions. OffCut is not liable for carrier delay, loss or damage except where the law does not permit that liability to be excluded.
Sellers may pay to boost a listing so it appears higher in the feed, category and search results for a fixed period, with a "Featured" badge. Current boosts are Quick Bump (48 hours), Spotlight (7 days) and Bulk Clearance (14 days); prices are shown before you pay and may change. Boosts improve placement only: they are not a guarantee of views, enquiries or a sale, and are non-refundable once the boost has started.
OffCut Pro includes 15 boosts per membership year, allocated strictly as 10 Quick Bumps, 4 Spotlights and 1 Bulk Clearance. Included boosts:
Members can invite others using their personal invite link or QR code. Where the referral programme is running, both the inviter and the new member may receive OffCut fee credit. Fee credit:
An order qualifies for the reward only where OffCut's estimated net margin on that order remains at least £1 after the seller's item and postage proceeds, payment processing fees, payout or transfer charges and any other defined variable transaction costs have been deducted. The reward is applied in full or not at all: where the estimated net margin would fall below £1, no reward is applied to that order and the reward remains available for the member's next qualifying purchase.
We may vary, suspend or withdraw the programme, the credit amount, the cost assumptions and the caps at any time, and may cancel credit obtained through duplicate accounts or any other abuse.
Sellers must:
You may not list stolen goods, asbestos or asbestos-containing materials, hazardous or controlled waste, counterfeit products, items subject to a recall, or anything whose sale is restricted by law. We may remove any listing at our discretion.
Selling a bladed article or knife to a person under 18 is a criminal offence in the United Kingdom under the Criminal Justice Act 1988 and the Offensive Weapons Act 2019. The following rules apply to every listing and every message on OffCut.
The following are strictly prohibited and will be removed, with the account suspended:
Genuine trade hand tools that incorporate a blade — for example hand saws, circular saw blades, chisels, planes, utility knife bodies, tile cutters and multi-tool blades fitted to power tools — may be listed only where:
The seller is solely and personally responsible for complying with these laws on every sale. OffCut is a venue, not the seller, and accepts no liability for any item traded in breach of this clause or of UK law. Our automated checks block bladed-item wording in listings and messages, but those checks are an aid and do not relieve you of your own legal duty. Reports of an attempted sale to a person under 18 will be acted on and may be passed to the police.
Personal protective equipment must be listed in the PPE & Site Safety category. When listing it you must choose the item type and its status and expiry, and you confirm a declaration that the item is genuine and complete, carries intact UKCA/CE markings and any readable date code, has never taken an impact, fall-arrest load or chemical spill, and is within any manufacturer expiry or service date.
Head protection and height safety equipment — including hard hats, safety helmets, harnesses, lanyards, karabiners and fall-arrest blocks — may only be listed brand new or unused in original packaging and in date. Used, expired, impacted or unmarked life-critical safety equipment is prohibited, and listings that attempt to avoid these questions by using another category are blocked and removed.
OffCut does not inspect, test, re-certify or guarantee the conformity, integrity or fitness for purpose of any protective equipment sold through the platform. Buyers must acknowledge this before checkout, and are responsible — together with their employer where relevant — for inspecting the item, checking markings and date codes, and satisfying themselves it is fit for purpose under their own risk assessment. The seller accepts sole product liability, and OffCut retains a permanent record of the declaration given.
Ladders, step ladders, hop-ups, podium steps, mobile alloy towers, staging boards and edge protection are work at height equipment and must be listed in the Access Equipment category. Sellers must describe the true condition, state the class or standard marking where it is present (for example EN 131, EN 1004 or BS 2037), and must not list equipment with cracked or bent stiles, damaged welds, seized or missing locking catches, or missing feet, braces, castors or platform boards. Incomplete mobile towers must be described plainly as incomplete.
OffCut does not inspect, test, load-test, certify or re-certify any access equipment sold through the platform. Buyers must acknowledge this notice before checkout and are responsible — together with their employer where relevant — for inspecting the equipment, confirming all components are present and sound, and recording it as safe to use under the Work at Height Regulations 2005 before anyone works from it. Mobile towers must be assembled by a competent, trained person following the manufacturer's instructions.
Bundles and job lots are sold as a single lot and must be described honestly, including approximate contents, quantities and condition. Most are collection only; where postage is offered, a pallet or courier service for a large lot is arranged between buyer and seller.
Where a seller supplies an estimated price when bought new, OffCut may display a comparison and an approximate saving. That figure is an estimate based on seller information and typical merchant prices, is not a quotation or a guarantee, and is not shown on offcuts, mixed lengths, part-used items or salvage where a like-for-like new price does not exist.
Listings show only the postcode area, never a street or full address. A seller's exact collection address is released to the buyer after payment is completed, and only for that order. Do not share addresses or contact details in public listings or in messages before purchase.
Messages are monitored automatically for restricted content, including attempts to move a deal off-platform. Abusive, harassing, discriminatory or fraudulent messages are not permitted. We may read messages where necessary to investigate a report, a dispute or suspected fraud.
If an item is significantly not as described, missing, or damaged, raise a dispute in the app within 48 hours of collection or delivery, with photographs. All refund requests are investigated by OffCut staff before any decision — refunds are never automatic.
Where we uphold a dispute, we may refund the buyer in whole or in part from held funds. Where we do not, funds are released to the seller. Our decision on the release of held funds is final for the purposes of the OffCut platform; it does not affect your legal rights against the other party.
For a delivered order, the buyer must check the goods before confirming arrival. Selecting “Yes” in the confirmation prompt releases the held item funds to the seller. If an item has not arrived or there is a problem, the buyer should select “No” and report the issue instead. Any refund of postage depends on the circumstances, the carrier's terms and the buyer's statutory rights; it is not automatic once carriage has been used.
Consumers buying from a business seller may have additional statutory rights, including a right to cancel distance purchases. Those rights are against the seller, not OffCut.
Buyers may rate and review sellers after an order completes. Quick feedback and detailed reviews must be honest and based on a real transaction. We monitor seller reliability, and where a seller's positive feedback falls below 80% over a meaningful number of reviews, or where they accumulate upheld disputes, their account is flagged for review.
Buyers may save a seller to find that seller and their future listings more easily. Saving a seller does not endorse them, guarantee future availability or change the terms of any order.
We may warn, restrict, suspend or permanently close an account for breaches of these terms, suspected fraud, repeated poor feedback, or off-platform dealing.
OffCut offers Free, Pro and Business plans. Pro is £8.99 a month or £79 a year; Business is £29.99 a month or £299 a year. Prices include VAT where applicable and are confirmed in the app before you subscribe.
Memberships are paid by card and renew automatically at the end of each billing period until cancelled. You can cancel at any time in your profile; your plan benefits continue until the end of the period you have already paid for, and we do not refund part-used periods. If a renewal payment fails we will let you know and may downgrade the account to Free until payment succeeds. We may change plan prices or features on reasonable notice; changes apply from your next renewal.
CO₂e figures shown in the app, including the everyday comparisons such as kettles boiled or miles driven, are estimates produced from the weight and material type recorded on a listing using published carbon factors. They are indicative only and must not be presented as audited or certified carbon savings, or relied on for regulatory, ESG or tax reporting without independent verification.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, OffCut is not liable for the acts or omissions of buyers or sellers, for the condition of goods, or for indirect or consequential loss. Where we are liable, our total liability for any order is limited to the fees we received on that order.
You can close your account at any time. Closure does not cancel obligations on open orders or disputes, and we may keep records where the law requires it.
We may update these terms; the date at the top shows when they last changed, and continued use means you accept the current version. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
